The parties propose nine months of discovery after a ruling on the motion to dismiss (if denied). The Court will permit six months of discovery. All discovery is stayed pending a ruling on the motion to dismiss. The parties have engaged in settlement discussions, but are at an impasse. Plaintiff seeks a settlement conference, but Defendant wants a ruling on the motion to dismiss. The parties must meet and confer about settlement one week after the filing of the motion to dismiss. The parties must file a status report two weeks after the filing of the motion to dismiss. The parties must provide an update, including whether the parties seek a settlement conference. As an aside, under the Federal Rules and the Local Rules, there is no need for a certificate of service for a filing on CM/ECF if everyone already gets a copy on CM/ECF.
