Filing 14 MINUTE entry before the Honorable Robert W. Gettleman: On June 24, 2024, plaintiff was ordered to file an amended complaint establishing subject matter jurisdiction. His amended complaint #7 fails to comply with the court's order. It refers to "Article III Section 2 Clause 1 of the Constitution" extending jurisdiction to "All CASES OF ADMIRALTY AND MARITIME JURISDICTION," but the amended complaint is brought against JP Morgan Chase Bank for breach of contract for failing to release a "Certificate of Deed." The amended complaint contains no allegations to support admiralty jurisdiction. Nor does the amended complaint establish jurisdiction under 28 U.S.C. 1332 (diversity of citizenship) because it fails to identify the citizenship of the parties and indicates that the amount in controversy is less than the required $75,000. Finally, the allegations of the amended complaint remain indecipherable and fail to state a claim arising under federal law. Consequently, the complaint is dismissed without prejudice. Filing 5 MINUTE entry before the Honorable John J. Tharp, Jr: Upon review of the plaintiff's complaint #1 , it fails to adequately establish subject matter jurisdiction. A complaint must contain a "short and plain statement of the grounds for the court's jurisdiction," which this complaint fails to include. Fed. R. Civ. P. 8(a)(1). A federal court may assert jurisdiction over a claim when it arises "under the Constitution, laws, or treatises of the United States" pursuant to 28 U.S.C. 1331, or there is complete diversity among the parties, pursuant to 28 U.S.C. 1332. The civil cover sheet states that this Court's jurisdiction is based upon diversity of the parties, but the complaint contains no allegations regarding the citizenship of the plaintiff or the defendant. See HCP III Arlington TS LLC v. Grupo Cinemex, S.A. de C.V., 534 F. Supp. 3d 921, 922 (N.D. Ill. 2021) ("[I]f jurisdiction depends on diversity of citizenship, the party invoking federal jurisdiction shall identify the citizenship of each party to the litigation.") (cleaned up). The plaintiff's allegations are indecipherable and do not state a claim arising under federal law. Further, though the complaint refers to several federal statutory provisions, all of which are definition provisions of various titles, none of the cited provisions give rise to a federal claim. The plaintiff is directed to file an amended complaint, establishing the basis for this Court's jurisdiction, by 07/08/2024.
