October 16, 2024 Opinion or Order Filing 9 ORDER: Plaintiff's application to proceed without prepayment of fees #4 is granted. The court appoints the U.S. Marshals Service to serve defendants. The clerk shall issue summons and send a copy of the completed USM-285 forms, 6 7 , to the U.S. Marshals Service. The Marshals Service is authorized to send a request for waiver of service to defendants in the manner prescribed by Federal Rule of Civil Procedure 4(d) before attempting personal service. The motion for attorney representation #5 is denied. Counts V (Monell Liability) and VI (Fourteenth Amendment/Americans with Disabilities Act) against the City of Chicago are dismissed without prejudice for failure to state a federal claim, but the City of Chicago remains a defendant for purposes of indemnification. The court will schedule a status report or status hearing after the U.S. Marshals Service completes service of process on defendants. If Plaintiff's address changes, he must promptly file a notice with the court.
