| Filing 5 MINUTE entry before the Honorable Franklin U. Valderrama: Upon review of the complaint, the Court makes the following jurisdictional inquiry. Plaintiff premises jurisdiction on diversity of citizenship pursuant to the Class Action Fairness Act (CAFA), 28 U.S.C. 1332(d)(2)(A), R. #1 , para. 19, but the citizenship of Defendant is unclear. Under CAFA, only minimal diversity is required, and it is true that minimal diversity is almost surely satisfied in light of the proposed nationwide class, but it is always better to confirm jurisdictional facts. Specifically, the complaint alleges that Defendant is a limited liability company (LLC) with its principal place of business located in Chicago, Illinois. However, an LLC's citizenship is not like a corporation's; instead an LLC is a citizen of every state where its members are citizens. Wise v. Wachovia Securities, LLC, 450 F.3d 265, 267 (7th Cir. 2006). Accordingly, in the joint initial status report, in the section on subject matter jurisdiction, Defendant shall identify its members and their States of citizenships. Mailed notice. (jcm) |
