Filing 11 MINUTE entry before the Honorable Georgia N Alexakis: Plaintiff has filed a complaint listing its name as "Patent Holder Identified in Exhibit 1." In Exhibit 1, plaintiff has separately filed under seal a copy of the patent at issue, which names the patent holder (which the Court presumes is plaintiff's true name). Because this document was filed under seal, only the Court (and not the public) knows plaintiff's identity. Federal Rule of Civil Procedure 10(a) provides that the "title of the complaint must name all the parties." Fed. R. Civ. P. 10(a). This requirement is mandatory. The Seventh Circuit has "repeatedly voiced [its] disfavor of parties proceeding anonymously, as anonymous litigation runs contrary to the rights of the public to have open judicial proceedings and to know who is using court facilities and procedures funded by public taxes." Doe v. Village of Deerfield, 819 F.3d 372, 37677 (7th Cir. 2016). To proceed anonymously, "a party must demonstrate 'exceptional circumstances' that outweigh both the public policy in favor of identified parties and the prejudice to the opposing party that would result from anonymity." Id. at 377. Here, plaintiff did not even request leave of the Court to hide its identity from the public, let alone establish that "exceptional circumstances" justify doing so. Plaintiff's complaint #1 is therefore stricken for failure to comply with the Federal Rules. See XYZ Corp. v. P'ship & Unincorporated Associations Identified on Schedule "A", No. 20-CV-6610, 2020 WL 6681360, at *1 (N.D. Ill. Nov. 12, 2020) (striking complaint for filing anonymously without seeking leave to do so). Plaintiff's pending motions for entry of a restraining order #6 and to seal the Schedule A #8 are denied without prejudice to renewal after a Rules-compliant is filed on the docket. Plaintiff may file a new complaint complying with Rule 10(a) by 11/6/24; otherwise, the dismissal will automatically convert to a dismissal with prejudice. For future cases, plaintiff is instructed not to file anonymously without seeking the Court's leave to do so, even in the rare case where an anonymous filing might be justified. No appearance is necessary on 11/4/24. (ca, ) |
