Filing 1 EXECUTIVE COMMITTEE ORDER: Beginning on October 25, 2024, Mr. Franks has repeatedly called the Clerk's Office in some instances up to 15 calls per hour. During these phone calls, Mr. Franks harasses the staff, uses profane and derogatory language, and makes threatening statements, including physical violence. These remarks caused concern for the safety of individuals. In the late afternoon of October 25, 2024, Mr. Franks came to the Dirksen Courthouse and went to the 20th floor Clerk's Office. During his visit, Mr. Franks became agitated, screaming and cursing repeatedly, including threatening to cause physical harm to a staff member. Representatives of the United States Marshals Service were called to provide assistance and investigate the matter. Mr. Franks's unsuitable conduct has raised concerns among the Court, the Clerk's Office, and the U.S. Marshals Service. The Executive Committee finds that : - Mr. Franks's behavior on phone calls to the Clerk's Office are unacceptable, burdensome and have impeded and caused unnecessary distractions from court operations; and - there is sufficient cause for concern regarding Mr. Franks's conduct if he is not escorted during his time in the Dirksen U.S. Courthouse in Chicago, Illinois or the Roszkowski U.S. Courthouse in Rockford, Illinois, therefore IT IS HEREBY ORDERED that to maintain judicial security, Mr. David Franks is ordered to sign in upon arrival at the Dirksen U.S. Courthouse at 219 S. Dearborn Street, Chicago, Illinois, 60604 or at the Stanley J. Roszkowski U.S. Courthouse at 327 S. Church Street, Rockford, Illinois 61101, and IT IS FURTHER ORDERED that a representative of the U.S. Marshals Service will accompany Mr. Franks whenever he is present in the Dirksen U.S. Courthouse or in the Stanley J. Roszkowski U.S. Courthouse, and IT IS FURTHER ORDERED that telephone number (708) 586-7559, and any future phone number used by Mr. Franks, shall be blocked immediately from calling the United States District Court, Northern District of Illinois. IT IS FURTHER ORDERED that the staff is relieved from answering phone calls from Mr. David Franks. Should Mr. Franks call the Clerk's Office, the staff member should inform Mr. Franks that pursuant to this Order, they are relieved from talking to him due to his prior interactions with the Clerk's Office, and that Mr. Franks should submit all inquiries and filings in paper to the Clerk's Office by mail to: United States District Court, Northern District of Illinois, 219 South Dearborn, 20th Floor, Chicago, IL 60604. Mr. Franks can also use the drop box, located in the lobby of the Courthouses, or the website portal to submit his filings. IT IS FURTHER ORDERED that failure to comply with this order by not signing in when arriving at the Courthouse, or by continuing to call the Court or Clerk's Office may lead to further sanctions, including, but not limited to, monetary sanctions or being held in contempt of Court for failure to follow the directives of this Order, and IT IS FURTHER ORDERED That a miscellaneous docket with the title "In Re: David Franks" and case number 24 CV 11192 will serve as the repository of this order and any order or minute order entered pursuant to this order. The Clerk will also maintain a miscellaneous docket associated with the file. All orders retained in the file will be entered on that docket following standard docketing procedures. IT IS FURTHER ORDERED that the Clerk of Court shall cause a copy of this Order to be mailed to David Franks, 36 W. 65th St. #2, Westmont, IL 60559 (dcfrankphotography@outlook.com), via Certified Mail, return receipt requested.
