Filing 6 AMENDED complaint by Elaine Cauthen against FHN Memorial Hospital (pg, ) |
Filing 5 ORDER: Plaintiff, Elaine Cauthen, was formerly employed by defendant, FHN Memorial Hospital, and alleges that she was terminated and retaliated against for complaining about harassment because of her race in violation of Title VII of the Civil Rights Act of 1964. Plaintiff moves to proceed in forma pauperis thereby requiring this court to perform an initial review. Plaintiffs complaint fails to state a claim upon which relief may be granted and is dismissed without prejudice pursuant to 28 U.S.C. 1915(e)(2)(b)(ii). The substance of plaintiffs allegations are I believe I have been discriminated against because of my race, Black, and in retaliation for engaging in protected activity. This is insufficient to state a plausible claim. This ios not sufficient. See Ashcroft v. Iqbal, 556 U.S. 662, 678 (2009) (A claim has facial plausibility when the plaintiff pleads factual content that allows the court to draw the reasonable inference that the defendant is liable for the misconduct alleged.). Plaintiff is granted leave to file an amended complaint with 21 days which contains factual allegations including the nature of the harassment, the individuals who engaged in the harassment, factual content allowing an inference that the harassment and retaliation was based on plaintiffs race, and a plausible basis for employer liability. Failure to file an amended complaint within 21 could result in dismissal of the claim with prejudice. Signed by the Honorable Frederick J. Kapala on 12/11/2018: mailed notice(pg, ) |
