Filing 8 MINUTE entry before the Honorable Iain D. Johnston: On October 14, 2020, the Court ordered the parties to file position memoranda regarding whether cases 3:20-cv-50387 and 3:20-cv-50392 should be consolidated. But according to the Illinois ARDC, counsel for Manish Kharat and Sawan Management, LLC, has been suspended during the pendency of disciplinary proceedings against him. Therefore, the deadline to file the ordered position memorandum is extended until December 24, 2020. Also by that day, Mr. Kharat must either have new counsel appear for him or file an appearance indicating that he is proceeding pro se, while Sawan Management, LLC, must have new counsel appear, as an LLC cannot proceed pro se. See 1756 W. Lake St. LLC v. Am. Chartered Bank, 787 F.3d 383, 385 (7th Cir. 2015). Failure to timely respond to this order may result in consolidation of these cases without the benefit of argumentation from both sides. The Clerk of Court is directed to mail a copy of this order and the October 14, 2020, order to Manish Kharat and Sawan Management, LLC: according to Dkt. 6 in 20-CV-50387 service is being attempted on Mr. Kharat at 1093 Millwood Ct., Brentwood, TN, 37027, while the Illinois Secretary of State lists Sawan Management, LLC's address as being 3909 11th Street, Rockford, IL, 61109.
