ORDER GRANTING in part and DENYING in part 41 MOTION for Summary Judgment filed by Defendants Village of Pontoon Beach, Aaron Morgan, Chris Modrusic and Charles Luehmann. Defendants' Motion is hereby GRANTED, as to the following two claims on ly: Counts Three and Six of Plaintiff Hantak's complaint (Doc. 4 )---§ 1983 and Illinois State law civil conspiracy claims---against Officers Morgan and Modrusic, and Chief Luehmann. Accordingly, Counts Three and Six are hereby DISMISSED with prejudice. Defendants' Motion is DENIED as to all other counts (One, Two, Four, Five and Seven); and they SHALL proceed to Jury Trial. In light of the foregoing, at the close of this action, after the Jury Trial on the remaining counts is complete, Judgment SHALL be entered in favor of Defendants Luehmann, Modrusic and Morgan, and against Plaintiff Christopher Hantak, on Counts Three and Six of his complaint (Doc. 4). MEMORANDUM AND ORDER re 38 appeal of Plaintiff Hantak, setting aside 36 order denying motion to disclose, vacating referral of 35 motion to disclose, and granting 35 motion to disclose. Dr. Case will be considered by the Court as timely discl osed as an expert for Hantak's main case. The Court on its own motion SETS the following deadlines: the parties may depose Dr. Case no later than September 23, 2010 and the Defendants may file a Daubert motion with respect to Dr. Case no later than October 7, 2010.
