ORDER REFERRING CASE to Magistrate Judge Stephen C. Williams, Stephen C. Williams added. Defendants Dave Matevey and Unknown Party (John Doe Police Officer) added. City of O'Fallon, IL and Ron & Jo's Gun Supplies Store terminated without p rejudice. IT IS FURTHER ORDERED that the Clerk of Court shall prepare for Defendants JOHN DOE EMPLOYEE OF RON & JOS GUN SHOP, MATEVEY, OFALLON POLICE DEPARTMENT, and JOHN DOE POLICE OFFICER (1) Form 5 (Notice of a Lawsuit and Request to Waive Servic e of a Summons), and (2) Form 6 (Waiver of Service of Summons). Service shall not be made on the Unknown (John Doe) Defendants until such time as Plaintiff has identified them by name in a properly-filed amended complaint. ORDER dismissing the claims against Defendants O'Fallon Police Department and City of O'Fallon without prejudice, David Mativez terminated without prejudice and Plaintiff's Section 1983 claim against Defendants Ron and Jo's Gun Su pply store and the John Doe employees of the store are dismissed without prejudice. Plaintiff is advised that he may amend his pleadings by March 16, 2011 and that failure to do so or to show cause as to why he has not complied with this order will cause this case to be dismissed for non-prosecution.
