Filing 6 ORDER DISMISSING CASE: IT IS HEREBY ORDERED that COUNTS 1 fails to state a claim upon which relief may be granted, and thus is DISMISSED with prejudice. The Court declines to exercise jurisdiction over COUNTS 2 and 3 and thus DISMISSES those claims without prejudice to Plaintiff refiling them in state court. Plaintiff cannot refile those claims in Federal Court. Plaintiff is advised that this dismissal shall count as one of his allotted strikes under the provisions of 28 U.S.C. § 1915(g).
