IT IS HEREBY ORDERED that the Complaint is DISMISSED without prejudice because Plaintiff has failed to name a proper defendant. Plaintiff's Motion to Appoint Counsel is DENIED. (Doc. 3). IT IS FURTHER ORDERED that, should he wish to proceed with this case, Plaintiff shall file his First Amended Complaint, identifying any person who was directly involved in the events complained of within 28 days of the date of his Order.
