September 17, 2018 Opinion or Order Filing 5 ORDER TRANSFERRING CASE. Plaintiff has submitted a civil rights complaint pursuant to 42 U.S.C. Sec. 1983, claiming his constitutional rights were violated while he was incarcerated at the Cook County Department of Corrections ("CCDOC"). Plaintiff is currently imprisoned at the Vienna Correctional Center in this District. Venue for federal civil rights actions brought under 42 U.S.C. Sec. 1983 is governed by 28 U.S.C. Sec. 1391(b). According to that statute, such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant is subject to the court's personal jurisdiction with respect to the action, if there is no district in which the action may otherwise be brought. Plaintiff names a single Defendant, CCDOC Superintendent Dart. All of the events or omissions giving rise to Plaintiff's allegations occurred at the CCDOC in Cook County, Illinois, which is situated in the federal judicial district for the Northern District of Illinois. 28 U.S.C. Sec. 93(a). Plaintiff's claims have no connection to the Southern District. The Court therefore finds that the Northern District is the appropriate forum for the hearing and determination of this civil rights action. Pursuant to 28 U.S.C. Sec. 1406(a), and on the Court's own motion, IT IS THEREFORE ORDERED that this action is TRANSFERRED to the United States District Court for the Northern District of Illinois, Eastern Division, for a determination as to whether Plaintiff should be granted leave to proceed in forma pauperis, 28 U.S.C. Sec. 1915, and such further proceedings as that court may deem appropriate. No summons shall issue in this action unless so directed by the transferee court. Signed by Judge Nancy J.
