Filing 4 ORDER: Plaintiff's request for an "emergency temporary injunction" in the Amended Complaint is construed as a request for a temporary restraining order ("TRO") and DENIED without prejudice. (Doc. 16, p. 21). A TRO is an order issued without notice to the party to be enjoined that may last no more than fourteen days. See Fed. R. Civ. P. 65(b)(2). A TRO may issue only if "specific facts in an affidavit or a verified complaint clearly show that immediate or irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition." Fed. R. Civ. P. 65(b)(1)(A). This relief is only warranted "to prevent a substantial risk of injury from ripening into actual harm." Farmer v. Brennan, 511 U.S. 825, 845 (1994). Plaintiff seeks confirmation that the BOP diet is nutritionally adequate, even if he refuses to consume egg- and meat-based products. He will not consume these products because of his religious beliefs. However, Plaintiff fails to identify any particular religion or religious beliefs that prevent him from consuming these foods. He does not allege that he has been denied alternative, nutritionally adequate options. He has also failed to describe any recent change in the diet or his health that may result in irreparable harm. Given that his complaint about the BOP's diet spans nine years, the Court is unable to conclude that a TRO is warranted to prevent any additional harm before the adverse party can be heard.
