August 7, 2019 Opinion or Order Filing 15 ORDER DENYING #10 Motion for Leave to File Amended Complaint as unnecessary. The Court previously granted Plaintiff leave to file a First Amended Complaint in a #9 Merits Review Order entered June 24, 2019. Plaintiff was invited to file a First Amended Complaint, if he wished to proceed with this action. He did so on July 25, 2019. However, the First Amended Complaint (Doc. 10) is UNSIGNED. Rule 11(a) of the Federal Rules of Civil Procedure requires that "[e]very pleading, written motion, and other paper must be signed... by a party personally if the party is unrepresented." Therefore, in order to proceed, Plaintiff is ORDERED to submit a properly signed First Amended Complaint, including exhibits, on or before August 22, 2019. Failure to comply with this Order shall result in the striking of Plaintiff's First Amended Complaint and dismissal of this action with prejudice and a "strike" under 28 U.S.C. 1915(g). See FED. R. CIV. P. 41(b). The CLERK is DIRECTED to return a copy of the First Amended Complaint (Doc. 10) to Plaintiff along with this Order. Signed by Judge Staci M. Yandle on 8/7/2019. August 2, 2019 Opinion or Order Filing 13 NOTICE AND ORDER: This Court has received your complaint (your motion to proceed without prepayment of the filing fee has already been granted) from the Central District of Illinois (Urbana), previously assigned case number: 19-cv-2104-CSB. Your new case number is: 19-cv-845-SMY. The following is some information you should know regarding the initial stages of your lawsuit. June 13, 2019 Opinion or Order TEXT ORDER Entered by Judge Colin Stirling Bruce on 6/13/2019. Plaintiff filed a Motion to Request Counsel #3 . Plaintiff has no constitutional or statutory right to counsel in this case. In considering the Plaintiff's motion, the court asks: (1) has the indigent Plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself? Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). Plaintiff has not shown that he made a reasonable effort to obtain counsel on his own. A plaintiff usually does this by attaching copies of letters sent to attorneys seeking representation and copies of any responses received. Because Plaintiff has not satisfied the first prong, the Court does not address the second.
