June 29, 2020 Opinion or Order Filing 13 MOTION for Recruitment of Counsel by Lynette R. Jackson. (jaj)
June 12, 2020 Opinion or Order Filing 12 ORDER denying #3 Motion for Appointment of Counsel. Civil litigants do not have a constitutional or statutory right to counsel. Pruitt v. Mote, 503 F.3d 647, 649 (7th Cir. 2007). Under 28 U.S.C. 1915(e)(1), the Court has discretion to recruit counsel to represent indigent litigants in appropriate cases. Johnson v. Doughty, 433 F.3d 1001, 1006 (7th Cir. 2006). When determining whether to grant a plaintiff's request for recruitment of counsel, the court must consider two questions: "(1) has the indigent plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself?" Id. at 654. The first prong of the analysis is a threshold question. If a plaintiff has made no attempt to obtain counsel on his own, the court should deny the request. Pruitt, 503 F.3d at 655. Here, Plaintiff has not met the threshold burden of demonstrating attempts to obtain counsel on her own. She merely asserts that she has made diligent efforts to obtain legal counsel without providing evidence such as a list of attorneys she has contacted and copies of letters she sent or received. As such, Plaintiff's Motion for Appointment of Counsel is DENIED without prejudice. Plaintiff may refile her motion, providing documentation of her efforts to obtain counsel and the responses received. Signed by Judge Staci M. Yandle on 6/12/2020.
