Date Filed Document Text
September 30, 2021 Opinion or Order Filing 23 ORDER. Plaintiff's Motion for Recruitment of Counsel (Doc. #3 ) is DENIED. The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court conducts a preliminary review of the Complaint under 28 U.S.C. 1915A, which requires the Court to screen prisoner Complaints to filter out nonmeritorious claims. 28 U.S.C. 1915A(a). Given the early stage of the litigation, it is difficult to accurately evaluate the need for assistance of counsel, so the recruitment of counsel would be premature. See Kadamovas v. Stevens, 706 F.3d 843, 845 (7th Cir. 2013) ("[U]ntil the defendants respond to the complaint, the plaintiff's need for assistance of counsel... cannot be gauged."). If Plaintiff's Complaint survives Section 1915A review, and he encounters difficulties in self-representation as this case proceeds, he may refile his motion seeking recruitment of counsel. If he chooses to renew his request, he should submit rejection letters from at least 3 attorneys to demonstrate that he has made reasonable efforts to obtain counsel on his own. Signed by Judge Staci M. Yandle on 9/30/2021. (ksp)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.

The Court will conduct the merit review of the Complaint pursuant to 28 U.S.C. 1915A within the next sixty days. Signed by Judge Staci M. Yandle on 9/24/2021. (ksp)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.
September 24, 2021 Opinion or Order Filing 20 SUPPLEMENT by Leszek Powelkowski. Supplement to #1 Complaint. (kare)
September 24, 2021 Opinion or Order Filing 19 ORDER DENYING #18 Motion for Extension. Plaintiff states he is attempting to obtain counsel and seeks an extension of time. Plaintiff filed the instant lawsuit on August 3, 2021 with an unsigned Complaint (Doc. 1). He has been advised four times that he needs to file a signed Complaint (Docs. 7, 13, 16, 17) and the Clerk sent him a copy of his unsigned Complaint twice to assist him (Doc. 7, 16). The only court imposed deadline is for Plaintiff to file a signed Complaint by September 29, 2021 or this case will be dismissed (Doc. 16). Plaintiff does not need counsel to file a signed Complaint and, therefore, the motion is DENIED. Signed by Judge Staci M. Yandle on 9/24/2021. (ksp)THIS TEXT ENTRY IS AN ORDER OF THE COURT. NO FURTHER DOCUMENTATION WILL BE MAILED.

Plaintiff filed an unsigned Complaint (Doc. 7) in this case and the only deadline is for him to file a signed Complaint by September 29, 2021 or this case will be dismissed (Doc. 16). Plaintiff does not need counsel to file a signed Complaint and, therefore, the motion is DENIED. Signed by Judge Staci M. Yandle on 9/20/2021. (ksp)THIS TEXT ENTRY IS AN ORDER OF THE COURT. September 20, 2021 Opinion or Order Filing 16 ORDER AND NOTICE OF IMPENDING DISMISSAL. In response to the Notice of Impending Dismissal (Doc. 13), Plaintiff filed a letter stating he wants to pursue this case and is seeking counsel to represent him (Doc. 14). He did not, however, file a signed Complaint. The Court has notified Plaintiff twice that he must file a signed Complaint, or this case will be dismissed. (Docs. 7, 13). In light of Plaintiff's letter, the Court will GRANT a FINAL extension of time to September 29, 2021 for Plaintiff to file a signed Complaint. Specifically, Plaintiff is required to sign under "Declaration Under Federal Rule of Civil Procedure 11," which was blank on the Complaint filed on August 3, 2021 (see Doc. 1, p. 7). Plaintiff's failure to comply will result in dismissal of this action, without further notice, for filing an unsigned Complaint in violation of Federal Rule of Civil Procedure 11(a) and failure to comply with Court Orders under Federal Rule of Civil Procedure 41(b).
