October 5, 2021 Opinion or Order Filing 11 ORDER DENYING Plaintiff's motion to proceed in forma pauperis (Doc. #5 ). A federal court may permit an indigent party to proceed without pre-payment of fees. 28 U.S.C. Section 1915(a)(1). The Court is not satisfied from Odom's affidavit that he is indigent. Plaintiff's trust fund account balance as of August 16, 2021 was $1,373.61 (Doc. #5 ). Accordingly, the Court DENIES the motion for leave to proceed in forma pauperis (Doc. #5 ). Plaintiff shall pay the $402.00 filing fee no later than November 4, 2021. Failure to comply with this Order will result in dismissal of this action for failure to comply with a court order under Federal Rule of Civil Procedure 41(b). Fed. R. Civ. P. 41(b). Your new case number is 21-1204-SMY. Within 30 days of the entry of this Order, you are ORDERED to submit the $402.00 filing fee or a motion to proceed without prepayment of the filing fee. August 27, 2021 Opinion or Order Filing 4 ORDER: Illinois prisoner Teron Odom submitted a complaint but did not pay the Court's filing fee or apply for leave to proceed in forma pauperis. He also did not specify where the events underlying his complaint occurred, even though a grievance attached to the complaint suggests that they occurred at the Menard Correctional Center. If Plaintiff wants to proceed further, he has until September 30, 2021, to do two things: (1) either prepay the $402.00 filing fee or submit an application for leave to proceed in forma pauperis on the enclosed form along with a copy of his trust fund account statement showing all transactions to his account for the six-month period immediately preceding his initiation of this action (from February 3, 2021, to August 3, 2021); and (2) identify where the events described in his complaint occurred.
