July 12, 2022 Opinion or Order Filing 6 ORDER: On June 17, 2022, Plaintiff was ordered to clarify with the Court whether he intended the filing of the Complaint in this case to be an Amended Complaint in Case No. 21-cv-288-SPM or if he intended to file a new lawsuit (Doc. 4). Plaintiff failed to respond to that Order. Accordingly, the Court will review the Complaint pursuant to 28 U.S.C. 1915A and Plaintiff will be assessed a filing fee. Plaintiff is REMINDED that he has until July 18, 2022 to submit the $402.00 filing fee or a motion to proceed without prepayment of the filing fee or face dismissal of this case without prejudice for failure to prosecute (Doc. #2 ). June 17, 2022 Opinion or Order Filing 4 ORDER re #1 Complaint filed by Jonathan Judkins. The statement of claim is blank, but his request for relief seeks "expungement of records concerning the incident" (Doc. 1, p. 7). Although presented with very little information, it appears to the Court that the Complaint might be Plaintiff's attempt to amend his Complaint in Judkins v. Spiller, et al., Case No. 21-cv-288-SPM. In that case, Plaintiff was directed to file an Amended Complaint regarding his claims of due process violations in a disciplinary hearing. He also sought expungement of his disciplinary report in that case. Thus, Plaintiff is DIRECTED to clarify with the Court whether he intended his filing to be an Amended Complaint in Case No. 21-cv-288-SPM or if he intended to file a new lawsuit. If Plaintiff intended his filing to be his Amended Complaint, the Court will close this case and no filing fee will be assessed. On the other hand, if Plaintiff sought to file a new case, then the Court will review the Complaint pursuant to 28 U.S.C. 1915A and assess a filing fee. Plaintiff is DIRECTED to file a notice with the Court by July 1, 2022, indicating how he wants to proceed with his current filing.
