ORDER regarding Plaintiff's Notice of Dismissal (Doc. #6 ). Under Federal Rule of Civil Procedure 41(a)(1)(A), the plaintiff may dismiss an action without a court order by (i) filing a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment, or (ii) filing a stipulation of dismissal that is signed by all of the parties who have appeared. See Fed. R. Civ. P. 41(a)(1)(A). Here, the Notice of Dismissal states that Defendants have not answered or otherwise appeared and that Plaintiff wishes to dismiss the matter without prejudice. As a result, the Court need not take further action. Plaintiff effected the dismissal of the matter, without prejudice, with its Notice of Dismissal. See Nat'l Inspection & Repairs, Inc. v. George S. May Int'l Co., 600 F.3d 878, 883 (7th Cir. 2010) ("Claims dismissed pursuant to Rule 41(a)(1) are complete on the dismissal without any action by the district judge."). Signed by Judge David W.
