OPINION AND ORDER granting 47 Motion to Dismiss, this case is DISMISSED WITH PREJUDICE. Northern Tool is directed to submit the attorneys fees it reasonably incurred in bringing this motion within 14 days. Payne may raise any objections to those fees within 14 days thereafter. The Court will then award the appropriate fees for this motion, along with the fees from Northern Tools previous fee submission, which remains pending. OPINION AND ORDER granting in part and denying in part 38 Motion to Dismiss this case or exclude evidence of damages. The Court ORDERS the Plaintiff to supplement his Rule 26(a)(1) disclosures within 14 days, completing all of the required items t o the best of his current knowledge. The Court also ORDERS that the discovery period is extended through May 1, 2015. Any further extensions to the discovery period must be approved by the undersigned, and will not be granted absent exceptional circu mstances. Finally, the Court DIRECTS Northern Tool to file an affidavit detailing any attorneys fees and costs it has incurred relative to this motion, within 14 days.
