ORDER - TRANSFERRING ACTION TO NORTHERN DISTRICT OF INDIANA; The Court dismissed Imari Butler's complaint pursuant to 28 U.S.C. 1915A for failure to state a claim upon which relief may be granted. Dkt. 14. The Court directed Mr. Butler to file an amended complaint and show cause why the action should not be transferred to the U.S. District Court for the Northern District of Indiana. Mr. Butler filed an amended complaint suing the Commissioner of the Indiana Department of Correction and 15 IDOC employees at Miami Correctional Facility. Mr. Butler describes extensive violations of his rights while imprisoned at MCF. He does not provide any argument or explanation why the action should proceed in this court as opposed to the Northern District, where MCF is located. Dkt. 15. "For the convenience of parties and witnesses, in the interest of justice, a district court may transfer any civil action to any other district or division where it might have been brought or to any district or division to which all parties have consented." 28 U.S.C. 1404(a). Pursuant to 28 U.S.C. 1391(b)(2) and 1404(a), this action is transferred to the U.S. District Court for the Northern District of Indiana, South Bend Division. Copy Sent to Plaintiff Via U.S. Mail. ORDER DISMISSING COMPLAINT AND DIRECTING FURTHER PROCEEDINGS - Mr. Butler's complaint is dismissed pursuant to 1915A for failure to state a claim upon which relief may be granted. He will have through October 25, 2024, to file an amended complaint that states a plausible claim for relief against a proper defendant. Mr. Butler's motions regarding his initial partial filing fee of $11.33, dkts. #11 , #12 , and #13 , are denied. However, given the possibility that this action will be transferred to the Northern District of Indiana, the Court extends Mr. Butler's deadline to pay the initial partial filing fee through 28 days after the Court screens his amended complaint.
