May 8, 2015 Opinion or Order Filing 95 ENTRY ON CROSS-MOTIONS FOR SUMMARY JUDGMENT - the Court finds that Plaintiffs have not presented sufficient evidence to show that they are entitled to summary judgment on their RESPA claims, and have not presented sufficient questions of materi al fact to defeat Chase's motion for summary judgment on their RESPA and breach of good faith and fair dealing claims. Therefore, Plaintiffs' motion for partial summary judgment (Filing No. 59 ) is DENIED, and Chase's motion for summary judgment (Filing No. 61 ) is GRANTED. March 10, 2014 Opinion or Order Filing 36 ENTRY ON PARTIAL MOTION TO DISMISS - The Court finds that the Homeowners have failed to state a claim upon which relief may be granted in Counts II and IV of their Complaint. Therefore, the Court GRANTS Chase's Motion to Dismiss (Dkt. 14 ) on the Homeowners' claims of breach of contract and negligent supervision, retention, and training, and these claims are dismissed without prejudice.
