Filing 38 ORDER - Plaintiff rests her argument on individual phrases as the expense of the Severance Agreement as a whole. However, the Severance Agreement construed in its entirety shows that Mr. Youngs resigned all positions and was no longer Defendant 9;s employee after September 22, 2009. Because the employment relationship was severed for a reason other than disability or death, Plaintiff is not entitled to SRBA benefits. Accordingly, Defendant's Motion for Summary Judgment [Dkt. 7 ] is GRANTED, and Plaintiff's Cross Motion for Summary Judgment [Dkt. 13 ] is DENIED. Signed by Judge Sarah Evans Barker on 3/31/2014.
