ORDER granting 18 Motion to Dismiss with prejudice Count One. As to Count Two, we construe Defendant's motion as seeking dismissal for lack of subject matter jurisdiction and grant the motion. Plaintiff is urged to seek the assistance of co unsel in formulating an acceptable amended complaint should she choose to pursue further action. Plaintiff may file an amended complaint within 28 days of the issuance of this Order, if she does not, we will enter a final judgment in favor of Defendant and close this matter.
