ORDER granting in part and denying in part Defendant's 27 Motion for Summary Judgment. Defendant's Motion for Summary Judgment for Failure to Exhaust Administrative Remedies Dkt. 27 is DENIED with respect to Plaintiff's federal constitutional claim in Count I of his complaint and is GRANTED with respect to Plaintiff's state constitutional claim in Count I and to all claims pled in Counts II and III. The only claim remaining in this case is Plaintiff's federal claim that Defendant violated his rights under Article I, § 10 of the United States Constitution. Signed by Judge William T.
