Filing 74 ORDER - Aztec-TYPSA's 54 Motion for Leave to File Amended Exhibits is GRANTED IN PART such that [50-3] is STRICKEN and DENIED IN PART such that the belatedly submitted exhibit filed with that motion, [54-3], will not be considered. For the rea sons stated herein, the Court GRANTS Aztec-TYPSA's 32 Motion for Summary Judgment and DENIES the Co-Sureties' 47 Motion for Summary Judgment. The Court DENIES Aztec-TYPSA's 49 Motion to Strike Allegations and Affirmative Defenses in the Co-Sureties' Answer, as well as the Co-Sureties' 59 Motion for Leave to File an Amended Answer.
