The Clerk is instructed to terminate FedEx and Lallathin as def endants in this action. The Motion for Leave to File a Supplemental Reply (Filing No. 93) and Motion for Oral Argument (Filing No. 106 ) are DENIED. No partial final judgment will be issued at this time, instead, final judgment will be made upon conclusion of all claims in this action. In addition, the Clerk is directed to update the docket to reflect the correct spelling of Defendant Delbert E. Lallathin, Jr.'s name as noted in Filing No. [79-4].
