ENTRY - DISCUSSING 35 MOTION FOR SUMMARY JUDGMENT. The Defendants' Motion for Summary Judgment, Dkt. 35 , is GRANTED as to defendants Jace Dundich and Allen Ward, and DENIED as to Renaird Sanford. No partial final judgment shall issue a t this time. The Clerk is directed to terminate defendants Jace Dundich and Allen Ward as defendants in this action. The excessive force and failure to protect claims remain pending against defendants David Mosley and Renaird Sanford, respectiv ely. The Clerk is also directed to correct the spelling of defendant David Mosley's last name on the docket. The Magistrate Judge is requested to set a status conference to direct the further development of this action, including a settlement conference. Copies distributed via the distribution list. ENTRY DENYING MOTION TO STAY ACTION PENDING RESOLUTION OF CRIMINAL CHARGES AND DIRECTING FURTHER PROCEEDINGS - 19 Motion to Stay is denied. 22 Motion in Opposition to Staying This Action is terminated. The Defendants shall have through Thursday , September 14, 2017, in which to either: 1) file a dispositive motion in support of the affirmative defense that Gray failed to exhaust his administrative remedies prior to filing this lawsuit, 2) notify the Court that this affirmative defense is no t amenable to resolution through a dispositive motion, or 3) notify the Court that the Defendants will not pursue the affirmative defense of failure to exhaust. If a dispositive motion is filed, Gray shall have thirty (30) days from the date of the f iling in which to respond. The Defendants shall then have fifteen (15) days in which to reply.
