August 20, 2019 Opinion or Order Filing 65 ENTRY - GRANTING TARGET'S 42 MOTION FOR SUMMARY JUDGMENT. In order to survive summary judgment, Indiana law requires that a plaintiff alleging retaliatory discharge present evidence that directly or indirectly implies the necessary inferen ce of causation between the filing of a worker's compensation claim and the termination. Mosley did not present any such evidence. Therefore, Target's Motion for Summary Judgment is granted as to Count III of Mosley's Complaint--hi s claim for retaliatory discharge. For the reasons stated above, Target's Motion for Summary Judgment (Filing No. 42 ) is GRANTED as to all claims. Final judgment will follow in a separate order. (See Entry.)
