Filing 12 ORDER: This matter comes before the Court on Plaintiff's Motion to Substitute Party. [Dkt. #10 .] As noted in Plaintiff's Notice of Filing Amended Complaint [Dkt. 7], Plaintiff's Amended Complaint was filed pursuant to Rule 15 - specifically, Fed. R. Civ. P. 15(a)(1) - which permitted Plaintiff to amend his Complaint once a matter of course, without leave of Court, since Defendants have not filed responsive pleadings or motions under Rules 12(b), (e), or (f). In this circumstance, the filing of Plaintiff's Amended Complaint [Dkt. 8] effectuated the substitution of Ironworkers Local 22, Inc. as the properly-named defendant in place of International Association of Bridge, Structural, Ornamental, and Reinforcing Iron Workers' Union No. 147, Inc., and this substitution is already reflected on the docket. Nevertheless, to the extent necessary, the Court hereby GRANTS Plaintiff's Motion to Substitute Party. [Dkt. #10 .] The Clerk need not take any further action pursuant to this order.
