Filing 10 Mail Returned as undeliverable. #5 Entry, #4 Order on Motion for Leave to Proceed in forma pauperis sent to LOUIS HOLGER at 20309-006, Springfield Medical Center, Inmate Mail - Parcels, P.O. Box 4000, Springfield, MO 65801. (JDH) |
Filing 9 Entry Directing Further Proceedings - Plaintiff Louis Holger failed to provide the Court with a current address as directed in the Entry of February 15, 2019. Accordingly, his claims are dismissed without prejudice for failure to prosecute. The clerk is directed to terminate Plaintiff Louis Holger on the docket as a plaintiff. Plaintiff Edmond Hudmond Smith's motion to proceed in forma pauperis, dkt. #8 , is granted because the Court finds that the plaintiff does not have the assets or means to pay even an initial partial filing fee. Because the Prison Litigation Reform Act mandates that a prisoner will not be prohibited from bringing a civil action for the reason that he lacks the assets and means to pay an initial partial filing fee, 28 U.S.C. 1915(b)(4), the plaintiff will be granted a waiver of payment of the initial partial filing fee in this case. He is still obligated, however, to pay the full five dollar filing fee pursuant to the statutory formula set forth in 28 U.S.C. 1915(b)(2). See id. 1915(b)(1). The plaintiff's motion for time to file an amended complaint or to show cause why this action should not be dismissed, dkt #7 , is granted. The plaintiff shall have through April 7, 2019, in which to comply with the Entry of February 1, 2019, at docket number 5. Copies to Edmond Hudmond Smith, IV and Louis Holger via U.S. mail. Signed by Judge Jane Magnus-Stinson on 3/11/2019. (JDH) |
Filing 8 MOTION for Leave to Proceed in forma pauperis, filed by Plaintiff EDMOND HUDMOND SMITH, IV. (Attachments: #1 Exhibit - Statement, #2 Envelope)(JDH) |
Filing 7 MOTION for Extension of Time to Amend Complaint pursuant to the Court's #4 Order of February 15, 2019, filed by Plaintiff EDMOND HUDMOND SMITH, IV. (Attachments: #1 Envelope)(JDH) |
Filing 6 Mail Returned as undeliverable. #3 Magistrate Judge's Notice of Availability to Exercise Jurisdiction sent to LOUIS HOLGER at 20309-006 Springfield Medical Center, Inmate Mail/Parcels, P.O. Box 4000, Springfield, MO. (JDH) |
Filing 5 Entry Dismissing Complaint and Directing Further Proceedings - The plaintiffs shall have through March 7, 2019, in which to show cause why Judgment dismissing this action without prejudice consistent with this Entry should not issue. The Court further notes that the Bureau of Prison's website reflects that plaintiff Louis Holger Eklund, Register Number 20309-006, was released from prison on December 13, 2018. A court's ability to contact a litigant or the litigant's representative through the use of a reliable address is imperative to the court's ability to transmit its rulings and manage its docket. If Mr. Holger does not provide this Court with a current mailing address by March 7, 2019, his claims will be dismissed without prejudice for failure to prosecute. (See Entry). Copy to Edmond Hudmond Smith, IV and Louis Holger via U.S. mail. Signed by Judge Jane Magnus-Stinson on 2/15/2019.(JDH) |
Filing 4 Order Directing Further Proceedings - Plaintiff Edmond Hudmond Smith, IV's motion to proceed in forma pauperis, dkt. #2 , is denied as presented. He shall have through March 7, 2019, in which to renew his motion to proceed in forma pauperis by attaching a copy of the transactions associated with his institution trust account for the 6-month period preceding the filing of this action on February 8, 2019. See 28 U.S.C. 1915(a)(2). Otherwise, Mr. Smith must pay the $400.00 filing fee. Similarly, Plaintiff Louis Holger shall have through March 7, 2019, in which to either pay the $400.00 filing fee for this action or demonstrate that he lacks the financial ability to do so. The Seventh Circuit Court of Appeals has held that pro se plaintiffs may join in one action, in compliance with Fed. R. Civ. P. 20, but they must each either be assessed the full filing fee or have their in forma pauperis status assessed individually. Turley v. Gaetz, 625 F.3d 1005, 1011 (7th Cir. 2010) (discussing Boriboune v. Berge, 391 F.3d 852, 856 (7th Cir. 2004)). Copy to Edmond Hudmond Smith, IV and Louis Holger via U.S. mail. Signed by Judge Jane Magnus-Stinson on 2/15/2019. (JDH) |
