ENTRY - GRANTING MOTION FOR LEAVE TO PROCEED IN FORMA PAUPERIS, DISMISSING COMPLAINT, AND DIRECTING FURTHER PROCEEDINGS. For the reasons discussed in Part II, the complaint is dismissed for failure to state a claim upon which relief may be granted. Mr. Duke shall have through October 26, 2020, to file an amended complaint that resolves the deficiencies discussed in this Order or otherwise show cause why this action should not be dismissed. Mr. Duke shall also have through October 26, 2020, to pay his initial partial filing fee as directed in Part I. If Mr. Duke fails to comply with these orders, the Court may dismiss this action without further warning or opportunity to show cause. (See Order.) Copy to Plaintiff via US Mail.
