Filing 6 CLOSED JUDGMENT - Plaintiff shall take nothing by way of his Amended Complaint and this action is dismissed under Federal Rule of Civil Procedure 12(b)(1) for lack of jurisdiction. This is a final judgment. (Copy to Plaintiff via U.S. mail) Signed by Judge James R. Sweeney II on 11/10/2020.(JDC) |
Filing 5 ORDER - On November 3, 2020, Plaintiffs Brenda Thomas and J.M.C. filed an action in this Court against Defendant Shameka Newman, Thomas's sister. (ECF No. 1.) Plaintiffs allege that Thomas is the legal guardian of minor J.M.C.; that Thomas was hospitalized while out of state and asked Defendant to care for J.M.C. for three days; and that upon Thomas's release from the hospital, Defendant refused to re-turn J.M.C. (Id. at 5.) In essence, Thomas seeks judicial assistance in obtaining the return of her son. Federal courts are courts of limited jurisdiction. Amendment, it appears, could not cure the identified defects, so the case is dismissed without prejudice for lack of subject-matter jurisdiction under Rule 12(b)(1). ***SEE ORDER FOR ADDITIONAL INFORMATION*** (Copy to Plaintiff via U.S. mail) Signed by Judge James R. Sweeney II on 11/10/2020.(JDC) |
