Filing 10 ORDER - SCREENING AND DISMISSING THE COMPLAINT; Anthony Bush alleges that he slipped on the floor during an unplanned power outage at Marion County Jail 2. At the time, Mr. Bush was a pretrial detainee. He claims that the failure of the private jail operator to maintain a backup electrical generator caused his injuries and violated his constitutional rights. The complaint does not allege a constitutional violation and is dismissed for failure to state a claim upon which relief may be granted. The complaint is DISMISSED for failure to state a claim upon which relief may be granted. Mr. Bush has through October 18, 2021, to file an amended complaint. Otherwise, this lawsuit will be dismissed without further warning or ability to show cause. The amended complaint will completely replace the original. It must include every defendant, factual allegation, and legal claim that Mr. Bush wants to pursue in this lawsuit. It must also include the correct case number, 1:21-cv-02467-SEB-TAB, and the words "Amended Complaint" on the first page. The clerk is directed to send Mr. Bush a blank prisoner complaint form with his copy of this Order. The clerk shall also change his prisoner number to "994529" on the docket. Mr. Bush's motion for pauper status, dkt. #3 , is GRANTED. The Court does not assess an initial partial filing fee. Signed by Judge Sarah Evans Barker on 9/29/2021.
