Order on Filing Fee Status - On July 2, 2023, Plaintiff filed his complaint for this action, but has not paid the filing fee. Plaintiff must either pay the $402.00 filing fee for this action or demonstrate that he lacks the financial ability to do so by filing a motion for leave to proceed without the prepayment of the filing fee (in forma pauperis). Plaintiff shall have through August 31, 2023, to correct this deficiency. Failure to do so may subject the case to dismissal for failure to prosecute. Plaintiff's Motions for Default Judgment, Docket No. #4 ; Docket No. #7 , and Motion for Summary Judgment Docket No. #5 are DENIED as premature given that Plaintiff has not yet paid the filing fee nor been granted leave to proceed in forma pauperis. The Court DIRECTS the Clerk to provide a form motion for leave to proceed without the prepayment of the filing fee with this entry. Copy to plaintiff via US Mail.
