September 20, 2023 Opinion or Order Filing 8 ORDER - DISMISSING PETITION FOR WRIT OF HABEAS CORPUS AND DENYING MOTION FOR APPOINTMENT OF COUNSEL; Petitioner John Naylor filed a petition for a writ of habeas corpus challenging an August 2022 disciplinary proceeding from Pendleton Correctional Facility. Dkt. #1 . This petition is denied, and this action is dismissed pursuant to Rule 4 of the Rules Governing Section 2254 Cases in the United States District Court. Mr. Naylor's petition indicates that his disciplinary proceeding has not affected his custody for purposes of 2254. Dkt. 1. Additionally, the Court ordered Mr. Naylor to show cause why this action should not be dismissed, and he did not respond. Dkt. #5 . Because Mr. Naylor's sanction did not include the loss of good-time credits or a demotion in credit-class earning, Mr. Naylor's petition for a writ of habeas corpus is dismissed for lack of jurisdiction pursuant to Rule 4.
