Filing 20 Order Denying Petition for a Writ of Habeas Corpus and Denying Certificate of Appealability - Petitioner Bruce A. White seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254, challenging his murder conviction in Indiana state court case number 20C01-1003-MR-00001. Finding no instances of deficient performance, the Court nevertheless assesses the cumulative effect of the alleged instances of deficient performance, and finds no ineffective assistance of counsel. Trial counsel was n ot ineffective under the standard explained in Strickland. Mr. White's petition for a writ of habeas corpus is therefore denied. Jurists of reason would not disagree with this Court's resolution of his claims and nothing about the claims deserve encouragement to proceed further. Therefore, a certificate of appealability is denied. (See Order.) Signed by Judge James R. Sweeney II on 5/13/2019. (DMW) |
