Filing 56 ORDER ON PARTIES' CROSS MOTIONS FOR SUMMARY JUDGMENT - 31 Plaintiff's Motion for Summary Judgment related to his TCPA claim (Count II) is GRANTED and consequently the Defendant's Motion for Summary Judgment as to the same claim is DE NIED. 36 Defendant's Motion for Summary Judgment related to Plaintiff's FDCPA claim (Count I) with respect to paragraphs 30 and 31 (alleging violations of 15 U.S.C. §§ 1692d and 1692d(5), respectively) is DENIED because question s of material fact exist which preclude the entry of summary judgment. Defendant's Motion for Summary Judgment related to Plaintiff's FDCPA claim (Count I) with respect to paragraphs 32 (alleging violations of 15 U.S.C.§1692f) is GRANTED, and Defendant's request for sanctions is DENIED WITHOUT PREJUDICE.
