Filing 62 MEMORANDUM AND ORDER granting 31 Motion for Summary Judgment. Defendants Bos and Shipman are entitled to qualified immunity on Plaintiff's First Amendment claim. The regulations under which the publications and mail were censored, K.A.R. 44-1 2-601 and K.A.R. 44-12-325, are constitutionally valid because they are reasonably related to a legitimate penological interest. Furthermore, they were reasonably applied in this case. To the extent Plaintiff is alleging a procedural due process clai m in his response to Defendants' motion, the Court declines to consider it. Accordingly, the Court grants summary judgment in favor of Defendants. Signed by District Judge Eric F. Melgren on 09/11/2017. Mailed to Plaintiff Charley Hughes at Hutchinson Correctional Facility by regular mail. (aa) |
