Filing 78 ORDER ADOPTING REPORT AND RECOMMENDATIONS; It is ordered 1) Sears' objections to 70 are OVERRULED; 2) 69 REPORT AND RECOMMENDATIONS is hereby ADOPTED as the findings of fact and conclusions of law of Court; 3) Drees and Union's joint- motion for summary judgment on Sears' §1132(a)(1)(B) claim 58 is GRANTED.
