August 30, 2018 Opinion or Order Filing 7 MEMORANDUM OPINION AND ORDER: 1) Bruckmann's claims against the Covington Police Department are DISMISSED. As a result, the Clerk of the Court shall TERMINATE the Covington Police Department as a defendant in this action. 2) The Deputy Clerk shall prepare six (6) "Service Packets" for service upon the remaining defendants: (1) Police Officer D. Griswald, (2) Police Officer R. Jones, (3) Police Officer J. Zerhusen, (4) Police Officer P. Purvis, (5) Police Officer M. Robinson, and (6) Police Officer Hugenburg. The Service Packets shall include: a. a completed summons form; b. the complaint #1 ; c. this Memorandum Opinion and Order; and d. a completed USM Form 285. 3) The Deputy Clerk shall send the Service Packets to the USMS in Lexington, Kentucky, and note the date of delivery in the docket. 4) The USMS shall personally serve the six remaining defendants at the Covington Police Department at 1 Police Memorial Drive in Covington, Kentucky 41011. 5) Bruckmann must immediately advise the Clerk's Office of any change in his current mailing address. If Bruckmann fails to do so, the Court will dismiss his case. 6) If Bruckmann wishes to seek relief from the Court, he must do so by filing a formal motion sent to the Clerk's Office. Every motion Bruckmann files must include a written certification that he has mailed a copy of it to the defendants or their counsel and state the date of mailing. August 30, 2018 Opinion or Order Filing 6 ORDER: 1) Bruckmann's motion for leave to proceed in forma pauperis #2 is GRANTED. Payment of the $50.00 administrative fee is WAIVED. However, pursuant to 1915(b), Bruckmann must pay the $350.00 filing fee in the manner set forth below. 2) The initial partial filing fee is WAIVED. 3) The Clerk of the Court shall open an account in Bruckmann's name for receipt of the filing fee. The Clerk shall complete a Notice of Payment Form (E.D. Ky. 525 Form) with (a) Bruckmann's name, (b) his inmate registration number, and (c) this case number. The Clerk shall send a copy of this Order and the Notice of Payment Form to the Warden of the institution in which Bruckmann is currently confined. 4) Each month, Bruckmann's custodian shall send the Clerk of the Court a payment in an amount equal to 20% of his income for the preceding month out of his inmate trust fund account, but only if the amount in the account exceeds $10.00. The custodian shall continue such monthly payments until the entire $350.00 filing fee is paid. See 28 U.S.C. 1915(b)(2). 5) This matter stands submitted for initial screening pursuant to 28 U.S.C. 1915(e)(2) and 1915A. Signed by Judge William O.
