MEMORANDUM OPINION & ORDER, (1) DENYING AS MOOT pla's 16 motion to amend/correct order; (2) DENYING AS MOOT pla's 17 MOTION to Amend/Correct; (3) DENYING AS MOOT pla's 18 motion for status report; (4) pla's claims against df ts Lincoln County Jail & Garrard County, Kentucky are DISMISSED WITH PREJUDICE; (5) the pla's 8th Amendment claims against Will Hunkleberry, Dr. James Miller, Nurse Brown, & David Gooch in their official capacities are DISMISSED WITH PREJUDICE; (6) clerk is directed to issue summons for the following dfts: David Gooch, Jailer for the Lincoln County Jail, Nurse Brown of the Lincoln County Jail, Will Hunkleberry, Deputy Jailer of the Lincoln County Jail & Dr. James Miller of the Lincoln Count y Jail; (7) Lexington Clerk's office prepare copies of the Complaint & Amended Complaint & this order & USM 285 & issue summons; (a) if insufficient info exists to complete the summons or USM 285, clerk shall make an entry on the docket sheet; ( b) clerk hand deliver documents to the USM; (c) clerk get receipt from USM & make docket entry; (d) USM serve summons by certified mail or personal service; (8) w/in 40 days of entry of this order, USM shall send a service report to Lex clerk's office stating whether service has been accomplished; (9) USM is responsible for ensuring that each dft is serviced w/process; (10) clerk serve a copy of this order upon Kentucky Dept of Corrections & note on the docket sheet; (11) pla shall keep cou rt informed of current address; (12) further pleadings pla files w/court must be served upon each dft or counsel; (13) if District Judge or Mag Jduge receives any doc which has not been filed w/clerk or doesn't have a cert of service, will be disregarded by the court.
