August 15, 2018 Opinion or Order Filing 7 ORDER: THE COURT ORDERS as follows: 1. The Clerk of Court shall serve a copy of the Petition & this Order upon Respondent & Attorney General of Comm. of KY; 2. The Respondent shall assist the Court in fulfilling its duties under 18 U.S.C. 3771(b)(2). Respondent shall file a notice certifying its compliance with this paragraph within 45 days; 3. Within 60 days from the date of this Order, Respondent SHALL file an answer, motion, or other response that addresses both the substance of the claims; 4. With the response, Respondent shall indicate what transcripts are available, when they can be furnished & what proceedings have been recorded, but not transcribed. Respondent shall attach relevant parts of transcript or a narrative summary of the evidence; 5. Respondent shall file a copy of the brief submitted by Petitioner in an appellate court contesting his conviction; 6. Respondent shall file a copy of the brief submitted by prosecution in an appellate court relating to petitioner's conviction or sentence; 7. Respondent shall file a copy of the opinions & dispositive orders of the appellate court; 8. Upon filing of response, Clerk of Court shall forwarded the record in the this matter to the undersigned for further review; and 9. That all pleadings must be submitted to the Clerk of Court. Each party required to include certificate of service. Any document received that fails to include required certificate of service shall not be filed & shall be returned to the party or counsel submitting such document.
