March 30, 2020 Opinion or Order Filing 9 ORDER: 1. Reed's #7 Motion for Leave to Proceed in forma pauperis is GRANTED. Payment of the administrative fee is WAIVED. 2. Payment of the initial partial filing fee is WAIVED. 3. The Clerk shall open an account in Reed's name for receipt of filing fee. The Clerk shall complete this Court's Notice of Payment Form with (a) Reed's name, (b) his inmate registration number, and (c) this case number. The Clerk shall then send a copy of this Order and the Notice of Payment Form to the Warden of the institution in which Reed is confined. 4. Reed's custodian shall send the Clerk a payment each month out of Reed's inmate trust fund account. Payment should be in an amount equal to 20% of Reed's income from the preceding month. The custodian shall only send a monthly payment if the amount in Reed's account exceeds $10.00. The custodian shall continue the monthly payments until Reed's entire $350.00 filing fee is paid. 5. Reed must keep the Clerk's Office apprised of any change in his address. If Reed fails to notify the Clerk's Office of a change in his address, the Court may dismiss his case. 6. March 6, 2020 Opinion or Order Filing 6 ORDER: 1. Reed's motion for leave to proceed in forma pauperis [R. #3 ] is DENIED without prejudice because it is not supported with the proper documentation. 2. The Clerk's Office shall mark the assigned case number on (a) an Affidavit of Assets/In Forma Pauperis Application [AO 240 Form] and (b) a Certificate of Inmate Account Form [E.D. Ky. 523 Form]. The Clerk's Office shall then send these forms to Reed. 3. Within 30 days from the entry of this Order, Reed must either pay the $400.00 in filing and administrative fees up front and in full, or he must ask to pay the filing fee in installments over time by (a) completing the Affidavit of Assets/In Forma Pauperis Application [AO 240 Form], (b) having the Certificate of Inmate Account Form [E.D. Ky. 523 Form] completed and certified by prison staff, and (c) filing both documents with the Court. 4. If Reed fails to take the foregoing steps within the time allotted, the Court will dismiss his case without prejudice for failure to prosecute. 5. Finally, Reed must keep the Clerk's Office informed of his current address. If Reed fails to notify the Clerk's Office of a change in his address, the Court will dismiss his case.
