September 10, 2024 Opinion or Order Filing 7 SCHEDULING ORDER: DISCOVERY 1. All fact discovery due by 4/28/2025; 2. The parties shall observe the following directives regarding the filing of discovery materials unless the Court otherwise specifically so orders: Rule 26(a)(1) shall not be filed. Expert witnesses and any report req'd by Rule 26(a)(2) due NLT 2/3/2025 for ptff and NLT 3/3/2025 for def; 3. Discovery disputes should be resolved in the following manner; 4. Amend pleadings and join addt'l parties due NLT 10/21/2024. DISPOSITIVE MOTIONS 1. Dispositive motions, motions in limine, and/or Daubert motions due NLT 5/26/2025. PRETRIAL 1. FINAL PRETRIAL CONFERENCE set for 9/8/2025 at 02:30 PM in FRANKFORT before Judge Gregory F. VanTatenhove; 2. NLT 30 days prior to the final PTC, counsel shall file the following: a witness list, a list of exhibits, page and line designations of witnesses. NLT 14 days prior to final PTC, counsel shall file: written objections, responses to motions in limine. NLT 10 days prior to the final PTC, counsel shall file: a pretrial memo, a copy of the Agreed Proposed Jury Instructions, An Agreed Statement of the Case, Proposed voir dire, and any motions for ruling by the Court; 3. At the final PTC, counsel shall be prepared to: display to the Court all exhibits, Adv the Court they have displayed to opposing counsel, Discuss/make possible stipulations, demonstrate ability to use court's visual presentation system, discuss possibility of settlement; 4. Court Copies. JURY TRIAL set for 9/25/2025 at 10:00 AM in FRANKFORT before Judge Gregory F. VanTatenhove. EXTENSIONS OF TIME req to modify dates/deadlines shall be submitted upon motion filed prior to expiration of deadline and upon showing of good cause. REFERRAL TO MAGISTRATE JUDGE This matter is referred to a USMJ for the purpose of: 1. Supervising discovery and pretrial proceedings; 2. Conducting all pretrial and status conferences, est and ext discovery deadlines, and all other deadlines as may be req'd and ruling on non-dispositive motions, except motions in limine.
