ORDER: 1. The Clerk of the Court shall SUBSTITUTE in Warden Gregory Kizziah as the Respondent in this proceeding. 2. The Clerk of the Court shall send a copy of Patton's petition and this Order by certified mail to both (a) Respondent Gregory Kizziah, Warden at USP- McCreary, and (b) the United States Attorney for the Eastern District of Kentucky. 3. Within 60 days from the entry of this Order, the Respondent shall file a response to the petition. The response shall be in the form of a memorandum addressing the factual allegations and legal claims contained in the petition; neither a formal motion to dismiss nor a motion for summary judgment is necessary or appropriate for these proceedings. The Respondent shall also include as attachments any documentary evidence relevant to his response or Patton's claims generally. The Respondent shall address any procedural or other defenses applicable to the petition. 4. Patton must send a copy of every document he files with the Court to the Respondent or his attorney.
