Filing 8 ORDER: 1. Smith's motion to proceed in forma pauperis [Record No. #6 ] is GRANTED. In accordance with Section 1915(b)(1) Smith will be required to pay the $350.00 filing fee as set forth below: a. Within 28 days, Smith must pay $24.49 to the Clerk of the Court as an initial partial filing fee;b. The Clerk of the Court is directed to open an account in Smiths name for receipt of the filing fee. c. Each month, Smith's custodian shall send the Clerk of the Court a payment in an amount equal to 20% of his income for the preceding month out of his inmate trust fund account, but only if the amount in the account exceeds $10.00 and continue monthly payments until the entire $350 is paid. 3. The Deputy Clerk is directed to prepare four (4) "Service Packets" for service upon the United States of America and Defendants Stephanie Sumner, Ms. Lawson, and Carrie Cunnagin. 4. The Deputy Clerk is directed to deliver the Service Packets to the USMS in Lexington, Kentucky and note the date of delivery in the docket; 5. The USMS is directed to serve the USA by sending a Service Packet by certified or registered mail to the Civil Process Clerk at the Office of the US Attorney for the EDKy; and the Office of the Attorney General of the USA in Washington, D.C.; 6. The USMS is directed to personally serve Defendants Stephanie Sumner, Ms. Lawson, and Carrie Cunnagin at USP-McCreary in Pine Knot, Kentucky through arrangement with the FBOP; 7. If Smith wishes to seek relief from the Court, he must do so by filing a formal motion sent to the Clerk's office. 8. Smith is directed to immediately advise the Clerk's Office of any change in his current mailing address. Failure to do so may result in dismissal of this case. Signed by Judge Danny C.
