Filing 44 MEMORANDUM OPINION AND ORDER by Senior Judge Thomas B. Russell on 6/24/2013 re 10 Motion for Partial Judgment on the Pleadings. For all of the foregoing reasons the motion is GRANTED IN PART AND DENIED IN PART. Plaintiff Patricia Pace's negligence per se claim based on federal statutes and regulations is DISMISSED. Likewise, her causes of action under KRS Chapters 209 and 216, save for those rights expressly enumerated in KRS § 216.515, are also DISMISSED.
