Simpson III on 3/28/2019 - For the reasons stated in the Memorandum Opinion, Liberty's motion for summary judgment will be granted and Hugo's Estate's motion for summary judgment will be de nied. The court will enter a declaratory judgment that there is no possibility of coverage under the policies for claims made in the FAC and that Liberty has no duty to defend or indemnify Hugo's Estate in the underlying state court action. Filing 36 MEMORANDUM OPINION by Senior Judge Charles R. Simpson III on 3/28/2019 - For the reasons stated in the Memorandum Opinion, Liberty's motion for summary judgment will be granted and Hugo's Estate's motion for summary judgment will be de nied.
